A Will is a legal document in which a person specifies firstly who to administer his or her estate assets after death.

Importantly, the Will may also appoint Guardians for infant children. The Will goes on to state what will happen with the assets of the deceased and may include provisions to address issues such as Inheritance Tax, Asset Protection.

Having a Will is especially important for anyone running a business, as the Executors will have immediate powers to deal with contracts, orders, and employees. This would not be the case if a person dies intestate i.e. without a Will.

A Will is also particularly necessary if a person has, say, children from a previous relationship and wishes to make certain that the children are provided for.

It is entirely possible for a person to make a Will without specialist or legal advice. However, the importance of the Will is such that a person should not run any risk of the Will being invalid. A common failing with ‘home-made’ Wills is that the Will is not validly executed according to the very strict requirments of the Wills Act 1837.
